Mission Statement

OwnerAide believes that the most valuable asset of any service business is its good will. The Mission of OwnerAide is to connect property owners and managers with quality service professionals within their community to help encourage and build the local economy, create jobs locally and enhance the quality of life in the community by fostering good will among the community’s residents and businesses in a network of trusted relationships and groups.

OwnerAide

OwnerAide is an internet based platform where property owners and property managers (the “Owner”) and contractors, servicemen, materialmen, and others possessing skills, talents, capabilities, aptitudes, proficiencies and abilities in the building and property trades, and related products (the “Aide”) can be connected for property improvements, repairs, maintenance, management and other property related services and needs. This platform is accessible at www.owneraide.com and any other websites through which OwnerAide makes these services available.

This is a community policed, business networking website established to facilitate commercial relations between Owners and Aides. OwnerAide is not a property owner or manager and is neither affiliated with nor an agent for any property owners or managers. OwnerAide is not a contractor or provider of services or materials, and is neither affiliated with nor an agent for any contractors, servicemen, materialmen or others engaged in the building and property trades and related products. OwnerAide is not and will not be a party to any contracts or agreements entered into between Owners or Aides.

This Terms of Use and Services Agreement sets out the legally binding terms of a user’s use of this website, and by using this website you accept and agree to be bound by the terms of this Terms of Use and Services Agreement.

Eligibility of Users

This website and the services provided are available only to persons of legal age and competency to contract in the state in which the property is located or the services are rendered or the materials are supplied. By accessing or using this website, the users represent and warrant to OwnerAide and to each other that they are legally competent to engage in the activities and relationships occasioned by such use. To the extent that such use is made by or on behalf of a corporation, partnership, limited liability company or other legally fictional entity, the users represent and warrant to OwnerAide and to each other that they possess the agency and legal authority necessary to bind such entity.

Site User’s Code of Conduct

Users of this website agree that they shall not use this website to:

  1. Post false or misleading information concerning their business or property, or otherwise engage in fraud or deceptive practices;
  2. Make any arrangement or agreement that they do not intend to honor;
  3. Violate any law or regulation;
  4. Infringe upon the rights of others;
  5. Invade the privacy of others;
  6. Use this website to broadcast or disseminate information about others;
  7. Use this website to make or distribute unsolicited communications;
  8. Use this website to harass or improperly trouble any other user;
  9. Register more that one OwnerAide account;
  10. Contact any other user of this website to arrange a service or the sale of a product in violation of this Terms of Use and Services Agreement, or for any other reason or purpose contrary to, or inconsistent with, this Terms of Use and Services Agreement, or otherwise in a manner designed to evade and infringe upon the rights and interests of OwnerAide under this Terms of Use and Services Agreement;
  11. Post or publish any content that is obscene or pornographic or otherwise vulgar and offensive;
  12. Post or publish any content that is obscene or pornographic or otherwise vulgar and offensive;
  13. Illegally discriminate against or wrongfully promote harm to any person;
  14. Engage in or Promote illegal or harmful conduct;
  15. Tamper with or interfere with the operations of this website or infringe upon OwnerAide intellectual property rights;
  16. Engage in practices that simulate the appearance or function of the OwnerAide website;
  17. Participate in, either directly or indirectly, networks that have the purposes of creating a pyramid scheme or similar fraudulent practice;
  18. Encourage or assist any other person in doing any of the foregoing.

Functionality of this Website

This website may be used to facilitate the listing and booking services by and between Owners and Aides.

A user may view listings as an unregistered visitor to this website. As this website is intended only to facilitate business development, OwnerAide does not control the content of any listings. As previously noted, OwnerAide does not warrant the services or materials obtained through the use of this website, and thus does not make any representations or warranties with regard to the listings or their content.

If a user wishes to contract with an Owner or an Aide, the user must first register to create an OwnerAide account.

General Membership Account Registration

Owners and Aides may join as General Members and use the OwnerAide service at no cost. General Members will have the ability to participate in some, but not all of the features and services available within the OwnerAide community. In order to access additional features and services, including the ability to create a Private Branded Network, a user must become a Subscribing Member, as explained below. As used in this Agreement, the unmodified term “Member” encompasses both a General Member and a Subscribing Member unless the context or usage clearly evidences an alternative intent.

In order to access many of the features of this website and to contract with another user, a user must register to create an account and become a Member of OwnerAide. A user may register to join as a Member directly via this website, or as described in this section. Users are advised to refer to the OwnerAide Privacy Policy before registration and from time to time thereafter.

A user may also register as a Member by logging onto the user’s account with certain social or professional networking sites, such as Facebook® or LinkedIn®, and the user may link the user’s OwnerAide account to that networking site; provided that the user is authorized to provide the necessary login information to OwnerAide, or that the user otherwise allows OwnerAide to access the networking site in accordance with the applicable terms governing that site, without obligating OwnerAide to pay any fees or making OwnerAide subject to any obligations or limitations imposed by the networking site’s service providers.

Information obtained by OwnerAide by access through the user’s other networking site may be stored and made available for use on the OwnerAide website via the user’s OwnerAide account. OwnerAide makes no effort to review or verify any content on a user’s accessed networking sites for any purpose, and OwnerAide is not responsible for such content. OwnerAide reserves the right to reject any content for any reason whatsoever.

A Member may only have one active OwnerAide account. A Member’s OwnerAide account and profile page will initially be created by OwnerAide based upon the information the Member provides on registration. The information provided must be complete and accurate. The Member agrees to periodically update the information so that it always remains complete and accurate. %p OwnerAide may at anytime suspend or terminate a user’s OwnerAide account and the user’s access to this website at anytime and for any reason.

The Member’s OwnerAide account shall be accessed by a Member designated Password, which the Member shall keep confidential (the “Password”). The Member shall be solely responsible for any activities under the Member’s OwnerAide account and the Member shall immediately notify OwnerAide of any unauthorized use.

OwnerAide may at any time suspend or terminate a Member’s OwnerAide account and the Member’s access to this website at any time and for any reason.

Subscription Membership and Private Branded Networks

OwnerAide offers a unique Internet opportunity to Subscribing Members (“Subscriber(s)”) to have a non-exclusive, non-transferrable, limited license to privately brand the OwnerAide software program for the use of the Subscriber’s clients and business relations exclusively within the Subscriber’s on-line business portal (a “Private Branded Network”). Through the Private Branded Network, Subscribers will be able to build a network under the Subscriber’s trade name or mark of trusted relationships within the Subscriber’s business community and thereby create a source of repeat and referral business that results in the ultimate enhancement of the Subscriber’s business good will.

Subscriber Membership License, Pricing and Terms

Limited License: In order for a Member to obtain a non-exclusive, non-transferable, limited license for a Private Branded Network, the Member must become a Subscribing Member. Such license is granted for and shall exist only during the term of the subscription or any renewal or extension thereof, subject to termination as hereinafter provided. The license is limited and shall only entitle the Subscribing Member to privately brand the OwnerAide program for networking purposes in the conduct of the Subscribing Member’s business. The license is non-exclusive and OwnerAide reserves the unrestricted right to offer similar licenses to other Subscribing Members. The license is non-transferable without the express written consent of OwnerAide. Except for the grant of this non-exclusive, limited license, OwnerAide reserves to itself, its successors and assigns, all of its intellectual property rights, including, without limitation, technology, patents, copyrights, trademarks, service marks, graphics and logos associated with the OwnerAide software program, and the Subscriber shall have no rights or powers with respect thereto, but may be enjoined from the exercise thereof without regard to whether or not OwnerAide may otherwise have an adequate remedy at law, it being agreed that such intellectual property rights are unique.

Pricing: Subscriptions are priced annually. Subscription prices and policies may be disclosed to a Member at the time of subscription. The prices and policies as disclosed and as they may be modified from time to time upon notice, are deemed a part of this Agreement. OwnerAide will bill the Subscriber through an online account (the “Billing Account”) for the use of the OwnerAide program. The Subscriber agrees to pay OwnerAide through the means of the Subscriber’s Billing Account the annual subscription price and other charges as agreed to at the time of the Subscriber’s initial subscription, or as they may later be agreed upon at any renewal or extension of the subscription, for any use of the OwnerAide Program by the Subscriber or other persons (including Subscriber’s agents). The Subscriber authorizes OwnerAide to charge the Subscriber’s chosen payment provider (“Payment Method”) for the use of the OwnerAide program. The Subscriber agrees to make payment using that selected Payment Method. OwnerAide may correct any billing errors or mistakes that it makes even if it has already requested or received payment. The Subscriber agrees to OwnerAide storing the Subscriber’s payment information. Subscriber agrees that the Billing Account and Payment Method shall apply to any other services or products that OwnerAide may offer and the Subscriber may accept for a fee, either on a one-time or a subscription basis.

The terms of payment will be based on Subscriber’s Payment Method and may be determined by agreements between the Subscriber and the financial institution, credit card issuer or other provider of Subscriber’s chosen Payment Method. If the Subscriber initiates a chargeback or otherwise reverses a payment made through the Payment Method, OwnerAide may in its discretion terminate the Subscriber’s account immediately. If OwnerAide successfully disputes the reversal, and the reversed funds are returned to OwnerAide, the Subscriber is not entitled to a refund or to have its account or subscription reinstated.

Automatic Renewal: The Subscriber’s subscription will continue indefinitely until cancelled by the Subscriber. After the Subscriber’s initial subscription commitment period, and again after any subsequent subscription period, the subscription will automatically continue for an additional equivalent period, at the price initially agreed upon or as may subsequently be agreed upon renewal or extension. The Subscriber agrees that the Subscriber’s account will be subject to this automatic renewal feature. If the Subscriber does not wish the account to renew automatically, or if the Subscriber wants to change or terminate its subscription, the Subscriber must contact support@owneraide.com. If the Subscriber cancels its subscription, it may continue to use the OwnerAide program until the end of its then-current subscription term, after which the subscription will not be renewed. However, the Subscriber will not be entitled to a prorated refund of any portion of the fees or charges paid for the then-current subscription period. By subscribing, the Subscriber authorizes OwnerAide to charge the Subscriber’s Payment Method initially and again at the beginning of any renewal or extension of the subscription. The Subscriber also authorizes OwnerAide to charge the Subscriber for any sales or similar taxes that may be imposed on subscription payments. Upon the renewal of the subscription, if OwnerAide does not receive payment from the Payment Method provider, (i) the Subscriber shall pay all amounts due on the Billing Account upon demand, and/or (ii) OwnerAide may either terminate or suspend the subscription and continue to attempt to charge your Payment Method provider until payment is received (upon receipt of payment, the subscription will be re-activated and for purposes of automatic renewal, a new subscription commitment period will begin as of the day payment was received). The Subscriber’s non-termination or continued use of the OwnerAide program reaffirms that OwnerAide is authorized to charge the Payment Method.

Current Information: The Subscriber must provide current, complete and accurate information for the Billing Account. The Subscriber must promptly update all information to keep the Billing Account current, complete and accurate (such as a change in billing address, card number or expiration date), and must promptly notify OwnerAide if the Payment Method is canceled or if the Subscriber becomes aware of a potential breach of security (such as an unauthorized disclosure or use of the Subscriber name or password). If the Subscriber fails to provide OwnerAide any of the foregoing information, the Subscriber agrees to be responsible for fees accrued under the Billing Account. In addition, the Subscriber authorizes OwnerAide to obtain updated or replacement expiration dates and card numbers for such credit or debit cards as provided by the credit or debit card issuer.

Termination: The Subscriber may terminate its subscription at any time, for any reason, by contacting support@owneraide.com or sending OwnerAide, Inc. written notice of termination to OwnerAide 171 Foster St. Brighton, MA 02135. Notwithstanding a termination, the subscription will remain active until the end of the then-current subscription period (that is, the subscription period for which full payment had been made prior termination). OwnerAide may terminate the subscription by sending a notice of termination at the email address provided in the Subscriber’s profile. If OwnerAide terminates the subscription because of a breach of this Agreement, the Subscriber will not be entitled to any refund of unused subscription fees. All decisions regarding the termination of subscriptions shall be made in the sole discretion of OwnerAide. OwnerAide is not required to provide notice prior to terminating a subscription for cause. OwnerAide is not required, and may be prohibited, from disclosing a reason for the termination. After a subscription is terminated, all terms that by their nature may survive termination of this Agreement shall be deemed to survive such termination.

Project and Profile Listings

Users of OwnerAide, whether as Members or as users of a Subscriber’s private branded network, may post real property projects or business profiles on this website. A listing will be created on basis of answers to questions about the project or business to be listed, including: (i) the identity of the Owner’s project or the Aide’s business; (ii) information concerning the Owner’s “Project”, including the situs or location, the Project details, specifications and conditions, the Project budget and schedules; (iii) information concerning the Aide’s business products, skills, capabilities and professional licensing, pricing and other applicable considerations concerning the Aide’s “Profile;” all as the nature of either the Project or the Aide’s business may require for full, accurate and complete disclosure. Project photos and videos are recommended and may be displayed or this site or otherwise made accessible to a user in connection with project bid solicitations.

Identification Information, Non-Identification Information and Account Information, as those terms are defined in the OwnerAide Privacy Policy may also be required and obtained in connection with a Project or Profile. See the OwnerAide Privacy Policy.

A user’s listing may further establish the conditions, which must be met in order for another user to respond to the listing.

All Listings will be available to the public via this website. Use of this website may facilitate contracts between users by making the listing information and various tools available to users so as to enable the users to make informed decisions. A user is solely responsible for the decisions that are made.

OwnerAide does not endorse, recommend or sponsor any user or the user’s listing, and does not attempt to confirm a user’s identity or the veracity or accuracy of any listing. A user is responsible for determining the identity and suitability of others that are contacted through this website.

A user is advised seek and obtain such additional information, including information from other sources, as may be appropriate to the decision making process. OwnerAide shall not be liable to a user as a consequence of the user’s reliance solely upon the information obtained from this website.

A user is responsible for all information contained in listings that the user posts on this website, and shall insure that the user’s listing complies with any applicable state or federal laws and will not conflict with or infringe upon the rights of others. The user shall indemnify and hold harmless OwnerAide from any claims or liabilities attributable to the content or posting of a user’s listing on this website.

OwnerAide reserves the unilateral right and authority to remove, discontinue or disable access to any listing posted on this website at anytime, and for any reason, and without prior notice.

The users of this website may contract with one another concerning any project posted on this website only through the means of this website. OwnerAide will not be a party to such a contract. OwnerAide is not responsible for the legal and contractual obligations or duties of the users of this website.

Project Bids, Costs and Payment Procedures

When an Owner has posted a Project, the Owner shall then be the “Project Owner.” The Project shall then be available for view by users of this website and open for bid by a registered Aide.

When a bid is submitted to a Project Owner via this website, the bid will include: (i) the OwnerAide “Coded Identity” of the Aide; (ii) a link to an OwnerAide created limited “Bidder’s Profile” including reviews, ratings, references, capabilities and products, insurances, as well as typical billing rates among other things; (iii) if known to OwnerAide, an indication that the registered name of the bidder matches the social network name that the bidder has linked with his OwnerAide account; and (iv) an indication if there are any common members of a social network with whom the Owner and Aide are friended or associated, if known to OwnerAide through the Owner’s and Aide’s registrations; and (v) the “Project Cost.”

A Project Cost will be determined by the Aide submitting the bid..” The Project Cost is the amount bid by an Aide to perform the services or provide the materials required for the bid project. Applicable taxes may be added to the Project Cost.

When the bid is accepted, the Project Owner agrees to pay the Project Aide for the Project Cost of any accepted bid. Payment of the Project Cost is a condition to the acceptance of the bid. Upon the acceptance of the bid, the Owner shall provide to the Project Aide customary billing information, including name, billing address and, if agreed, credit card information for payment processing.

The Project Owner and the Project Aide shall then engage upon the necessary arrangements for the performance of the Project in accordance with the accepted bid, including the establishment of the “Project Completion Date.” The Project Owner and the Project Aide shall otherwise comply with applicable law governing such arrangements. OwnerAide shall not be responsible for such legal compliance and shall not be liable therefore. The Project Owner and the Project Aide shall indemnify and hold harmless OwnerAide from any claims or liabilities attributable to non-compliance with laws applicable to their engagement.

In the event that OwnerAide is summoned into court, sued or otherwise impleaded in litigation between the Project Owner and the Project Aide concerning the Project, OwnerAide shall be entitled to recover the fees and costs, including reasonable attorney fees, incurred in such litigation from the Project Owner and the Project Aide, jointly and severally.

If, a Project Owner wishes to cancel a Project after acceptance of a bid, but before the rendition of services or the provision of materials, the Project Owner shall notify the Project Aide.

Taxes

To the extent that OwnerAide is obliged by law to file or report tax information a state or federal revenue services concerning payments to users of this website, OwnerAide shall collect such information from users as may from time to time be necessary in order to meet such filing or reporting requirements, including IRS Forms W-9. Users of this website understand and agree that they are solely responsible for determining their applicable tax reporting requirements.

Use Licenses

Subject to the user’s compliance with this Terms of Use and Services Agreement, the user is granted limited license to only use this website for its intended purposes. This limited license is non-exclusive and non-transferable.

Except as expressly permitted regarding a Subscription for a Private Branded Network, no right or license is given to copy, distribute, license, sell, transfer, transmit, broadcast or otherwise exploit the content of this website, or to otherwise infringe upon or violate OwnerAide copyrights and property rights in any way.

No right or license is given with regard to the rights or properties of other users of this website, and any implied license with regard to the rights and properties of others is expressly disclaimed.

A user of this website grants to OwnerAide a non-exclusive, royalty-free license to: (i) use, copy, adapt, modify, reproduce in conjunction with the purposes of this website; (ii) to display, broadcast, transmit and otherwise publish and disseminate, via this website; and (iii) otherwise exploit for profit in a manner consistent with the purposes of this website, all content posted or listed on this website by the user (the “User Content”).

The user represents and warrants to OwnerAide that: (i) the user is solely responsible for all User Content; (ii) the user has all legal right, title, and/or interest, including licenses, privileges and authorities, in or to the User Content that are necessary to grant to OwnerAide the rights in such User Content contemplated by this Terms of Use and Services Agreement; and (iii) use of the User Content will not infringe upon or violate a third party’s property rights, or rights of publicity or privacy, or result in the violation of any law or regulation. The user shall indemnify and hold harmless OwnerAide from any claims or liabilities attributable to the content or posting of the User Content.

OwnerAide may provide links to electronic resources and other websites, including user websites. Owner aide is not responsible for the availability or integrity of such resources or websites. OwnerAide is not responsible for any content, products or services available from such websites or resources. OwnerAide disclaims any representations or warranties regarding the content, product or services found at such websites or resources. A user assumes all risks associated with the use of such resources or websites.

Limitations of Liability

OwnerAide is not an insurer or guarantor of the financial ability or creditworthiness of any users of this site, or of any of the services or materials obtained by the use hereof, all of which are provided without warranty or representation of merchantability, fitness for a particular purpose, quality, or title on the part of OwnerAide. All such representations or warranties, including those as may otherwise be implied by law, are expressly disclaimed by OwnerAide.

OwnerAide does not investigate the background of users of this website. Users engage the services or purchase the products at their sole risk, without warranty of any kind, either expressed or implied on the part of OwnerAide. No information obtained from OwnerAide through this website will create any warranty not otherwise expressly made under this Terms of Use and Services Agreement.

OwnerAide disclaims any and all liability attributable to the fault or misconduct of any contracting party engaged through this website. All users of this website agree that such use is at the user’s own risk, and that the user’s sole recourse for economic or personal loss or injury shall be to the other contracting party only.

OwnerAide shall not be liable to a user of this website for any consequential or incidental damages, including damages for personal injury or emotional distress, or for special or exemplary damages, arising out of or in connection with any communications, relationships, interactions, arrangements, contracts or agreements between or among users of this website, or their products or services, whether based upon contract, tort or other theory of liability, in law or equity. In any event, should a claim or action against OwnerAide arise out of or pertain to a Project, OwnerAide’s total liability for such claim or action shall not exceed the Total Cost of the Project.

Any claim or cause of action against OwnerAide must be commenced within two years of the date such claim or cause of action first accrued, or it shall be time barred. The validity, construction and enforcement of this Terms of Use and Services Agreement, and all claims arising hereunder shall be governed by the laws of the State of Connecticut (but not its conflicts of law provisions). All claims or actions arising directly or indirectly hereunder may only be litigated in Courts having situs within the State of Connecticut. Users of this website consent and voluntarily submit to the jurisdiction of the State of Connecticut, hereby appointing the Connecticut Secretary of State as their statutory agent for service of process.

Users of this website expressly waive trial by jury in any court and in any suit, action or proceeding on any matter arising in connection with or in any way related to this Terms of Use and Services Agreement and this website.

Arbitration

If any dispute, controversy or claim arising in connection with this Terms of Use and Services Agreement or the service provided through this website, (including disputes regarding the validity or enforceability of this Terms of Use and Services Agreement), either party may, upon written notice to the other party, request that the matter be mediated. Such mediation will be conducted by a neutral facilitator acceptable to both parties. Both parties will exert their best efforts to discuss with each other in good faith their respective positions in an attempt to finally resolve such dispute or controversy.

All such discussions, however, will not be admissible in any subsequent litigation against the disclosing party. Except as agreed by both parties, the mediator will keep confidential all information disclosed during the negotiations. The mediator may not act as a witness for either party in any subsequent arbitration between the parties.

The mediation proceedings will conclude within sixty days from receipt of the written notice unless extended or terminated sooner by mutual consent. The parties may also agree at any time to terminate or waive ongoing mediation. Each party will be responsible for its own expenses. The fees and expenses of the mediator, if any, will be borne equally by the parties.

If any dispute, controversy, or claim arises in connection with this Terms of Use and Services Agreement or the service provided through this website (including disputes regarding the validity or enforceability of this Terms of Use and Services Agreement) and cannot be resolved by mediation, (or the parties agree to waive that process or a party does not respond to the other party’s request that the matter be mediated within seven (7) days of receipt), then such dispute, controversy or claim will be settled by binding arbitration pursuant to the rules of the American Arbitration Association’s arbitration program and that the arbitrator(s) may award reasonable attorney’s fees to the prevailing party in such proceedings. The arbitration hearings will take place in Hartford, Connecticut. Such arbitration shall be binding and final.

Reportage and Notices

A user may submit feedback, comments or suggestions concerning this website by emailing OwnerAide at support@owneraide.com. Upon receipt, such feedback, comments and suggestions, and all rights thereto or interests therein, shall become the property of OwnerAide.

A user may report improper conduct or misbehavior by other users of this website by contacting OwnerAide at support@owneraide.com. The reportage of such improper conduct or misbehavior does not obligate OwnerAide to take any action with regard thereto, or cause OwnerAide to incur any liability associated therewith. Users are encouraged to report illegal conduct to proper authorities.

All notices or other communications from OwnerAide to users will be in writing and delivered to users electronically at the user’s registered address. Notices may also be posted on this website. Electronic deliveries are presumed received on the date sent.

Services Availability

The services provided under this Agreement are provided as they may exist and be available from time to time, and OwnerAide has no other obligations, except as expressly stated in this Agreement. For so long as OwnerAide continues to offer the services under this Agreement, OwnerAide may seek to update, improve and expand the services, may modify, replace, suspend or discontinue services partially or entirely, or change or modify prices prospectively and may withhold, remove or discard any content with or without notice, if deemed to be contrary to the purposes of this Agreement or the intended uses of the services.

Modification of Terms

OwnerAide reserves the sole and unilateral right to modify this Terms of Use and Services Agreement, this website and its contents at any time and without prior notice. By continuing to access or use this website after OwnerAide has posted a modification, the user is indicating that he or she agrees to be bound by the modified terms. If the user does not want to agree to changes to this Agreement, the user can terminate the Agreement as herein provided.

Privacy Policy

The OwnerAide Privacy Policy, as may be modified from time to time, is a part of this OwnerAide Terms of Use and Services Agreement.

This Terms of User and Services Agreement constitutes the entire and exclusive agreement between OwnerAide and users of this website and OwnerAide services. The failure of OwnerAide to enforce any provision of this Terms of Use and Services Agreement shall not constitute a waiver of the right to enforce that provision in the future. If for any reason an arbitrator or a court of competent jurisdiction finds any provision of this Terms of Use and Services Agreement invalid or unenforceable, the other provisions of this Terms of Use and Services Agreement will remain in full force and effect.

This Privacy Policy states OwnerAide policies and procedures regarding the collection, use and disclosure of personal information that OwnerAide receives from users of this website. OwnerAide may modify this Privacy Policy from time to time. This Privacy Policy is a part of the OwnerAide Terms of Use and Services Agreement.

Personal Identification Information

OwnerAide is an internet based platform where property owners and property managers (the “Owner”) and contractors, servicemen, materialmen, and others possessing skills, talents, capabilities, aptitudes, proficiencies and abilities in the building and property trades, and related products (the “Aide”) can be connected for property improvements, repairs, maintenance, management and other property related services and needs.

When a user registers with OwnerAide, the user is required to provide personal identification and contact information (“Identification Information”) such as the user’s:

  • a. name,
  • b. postal address,
  • c. phone,
  • d. email address,
  • e. date of birth,
  • f. Website,
  • g. federal tax id number (SSN or EID)
  • h. Geo-location

The OwnerAide registration may also require Identification Information concerning a business, including Identification Information regarding the business owners, officers or operators or authorized agents. Business Identification Information may include the business website and website URL and business license numbers.

In addition, registration may require billing and payment information for the user (“Account Information”) such as:

  • a. credit card number,
  • b. bank account number,
  • c. bank wire or electronic fund transfer information,
  • d. billing or payment postal address,

Identification Information and Account Information also may be obtained when a user registers through a third party social or business network account (a “TPN”) such a Facebook® or LinkedIn®, if this third party account is linked to the user’s OwnerAide account upon registration. (See the OwnerAide Terms of Use and Services Agreement regarding registration procedures.) A user registering on OwnerAide through a TPN affirms the truth and accuracy of the Identification Information and Account Information contained on the TPN, and authorizes OwnerAide to access, use and store that Identification Information and Account Information in connection with the user’s OwnerAide Projects, Profiles, products and services on the OwnerAide website.

Based on risk analysis, and to the extent reasonable and practicable, the Company will ensure that the Company reasonably knows the true identity of its customers by using risk-based procedures to verify and document the accuracy of the Identification Information. The Company requires documents to verify customer identity when appropriate documents are available. Appropriate documents include government issued identification for individuals and certified copies of government filed organizational documents for businesses, such as Articles of Incorporation, or business licenses. The Company may also use non-documentary means, such as obtaining references from reliable sources.

Additional information may be provided through the user’s listing or posting of a profile or a project on the OwnerAide website, or from the user’s TPN listings or profiles (Non-Identification Information). OwnerAide may combine Identification Information and Account Information with Non-Identification Information. The collected Identification Information, Account Information and Non-Identification Information is referred to as the “Personal Information.”

OwnerAide uses Personal Information to, among other things:

  • a. provide products and services,
  • b. to complete transactions,
  • c. to render bills,
  • d. to make payments,
  • e. to communicate,
  • f. and to administer programs,
  • g. assure compliance with OwnerAide’s Customer Identification Program (“CIP”).

The user authorizes OwnerAide to use and to share some or all of the Personal Information as needed for those purposes, as well as for other activities or uses that may be necessary or appropriate to the proper performance or fulfillment of those purposes.

OwnerAide will not collect Account Information in an unsecure or unsolicited communication.

Other Data Collection

OwnerAide automatically records data it receives electronically when someone visits this website (“Log Data”). This Log Data may include details of the visit and other information, including the visitor’s computer's internet protocol ("IP") address, browser type and browser version. OwnerAide also uses transferred data files or “Cookies” and electronic images or “Web Beacons” to collect data.

This data is used to monitor and analyze the use of this website and for administrative purposes, as well as to facilitate the use and administration of this website.

Information Sharing and Disclosure

When a user registers and creates an OwnerAide account, information is obtained to create a Profile page or Project. (See the OwnerAide Terms of Use and Services Agreement). OwnerAide then posts a limited “Public Profile” or limited “Public Project Listing” that will contain only limited or coded Identification Information, such as the identification of an Aide by trade, or of a person by first name and last initial, and generalized geographical information, such as city and state.

The limited Public Profile or Public Project Listing may also include qualified Non-Identification Information. The limited Public Profile and Public Project Listing will not include complete Identification Information or Account Information. The Public Profile or Public Project Listing will be displayed publicly on the OwnerAide website.

When an Aide presents a bid on an Owner Project (See the OwnerAide Terms of Use and Services Agreement), the Owner is provided with only the Aide’s Public Profile. When a bid has been accepted and OwnerAide has collected the Total Cost, the Project Owner and the Project Aide are each provided with Identification Information and any additional Non-Identification Information appropriate to the Project and the bid acceptance. Account Information is primarily used by OwnerAide only in the processing of payment transactions. Account Information is not shared with anyone except as may be allowed or required by law, or necessary to the enforcement of user obligations.

OwnerAide may freely share Non-Identification Information and other collected data with third parties as deemed useful to the management and administration of this website and the facilitation of OwnerAide services. In this case, shared information and data will not include Identification Information or Account Information.

If OwnerAide employs third party, independent contractors in connection with the management, operation or administration of this website, such third parties may have limited access to Personal Information for such purposes or otherwise as a consequence of their employment activities. These third parties are subject to non-disclosure agreements by which they are obligated not to use or disclose such Personal Information for any purpose other than as maybe necessary to the performance of their employment on behalf of OwnerAide.

For business development purposes, including communications regarding products and services, you may receive promotional e-mails from us, and we may share Personal Information with trusted OwnerAide business affiliates who are subject to the OwnerAide Privacy Policy. A user may opt to prohibit such sharing by contacting our support unit at support@owneraide.com

OwnerAide takes its legal obligations and responsibilities seriously. Subject to applicable financial privacy laws, OwnerAide may cooperate with government and law enforcement officials or with private parties acting under color of the law to enforce or comply with the law. OwnerAide may disclose Personal Information as it determines to be necessary or appropriate to properly respond to claims or legal process, or to protect the safety, property and rights of others.

OwnerAide may disclose Personal Information in the event of a sale of all or part of its assets, or the merger, acquisition, reorganization or bankruptcy of OwnerAide. In doing so, OwnerAide will comply with applicable financial privacy laws to protect the Account Information of OwnerAide users.

The OwnerAide website may contain links to other websites. An OwnerAide user chooses to visit another website through a link or banner advertisement. OwnerAide does not endorse any other business or its website, or make any representations or warranties regarding the websites or products of other parties. OwnerAide does not control the websites of other parties and such websites may not satisfy our Terms of Use or our Privacy Policy. Users that visit other websites though a link or banner ad on the OwnerAide website do so at their own risk. OwnerAide recommends that users study the privacy policies of other websites before visiting them. OwnerAide does not exercise control over third party websites.

Changing Personal Information

Owner Projects may not be modified or edited during any period that the Owner Project is open to bid, but may be withdrawn prior to acceptance of a bid. All registered users of OwnerAide may review, update, edit, or correct their Personal Information or Profile at anytime.

Registered users may cancel their OwnerAide registration at anytime. Cancellation will not terminate any then pending transactions or existing obligations or liabilities, and Personal Information will be retained until such time as OwnerAide is fully satisfied, in its sole discretion, that all pending transactions, obligations and liabilities of the user have been concluded or satisfied.

Notice

To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account.

What this means for you: When you open an account, we will ask for your name, address, date of birth and other information that will allow us to identify you. We may also ask to see your government issued identification or other identifying documents.
